Pics305 strives to be a company that is easy to work with from a customer perspective. The following terms & conditions apply from the moment of booking.
By accepting the terms and conditions, customer and Pics305 enter into this agreement:
These terms & conditions cannot be waived in any way by the clients unless such conditions are expressly agreed by the photographer in writing.
1. COPYRIGHT
i. Pics305 owns copyright of any and all images taken by a Pics305 photographer. Images may not be used by client nor any 3rd party for purposes of advertising or marketing unless it is previously stated. Business related photography (content creation, lifestyle photography, product photography, headshots, etc) may be used by client for all marketing or advertising purposes IF previously stated. National or regional use of images may be licensed. Contact us for licensing before or after service completion.
2. DISPLAY
i. The client(s) hereby allow(s) the Pics305 to display any photograph covered by this agreement and to promote the business in all types of Advertising, Editorials, Websites.
3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION
i. Photographs taken during the course of the event/shoot will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.
ii. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. The Photographer/s will do their best to honor the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather an the availability and willingness of subjects.
iii. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
4. PAYMENT
i. A non-refundable booking fee will confirm your booking, as well as full acceptance of the terms and conditions as stated.
ii. Titles to all goods remains with Pics305 until all services & costs are paid for in full by the client(s)
5. FORCE MAJEURE
i. In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid.
6. DIGITAL NEGATIVE FILES
i. Images delivered by Pics305 may be used for personal purposes. Business imaging is for direct corporate use and not intended for use by 3rd party. Imaging chosen for regional, national or international use my incur a license fee. E-mail Pics305 for licensing questions.
ii. Pics305 reserves its copyright privileges.
ii. Should the digital negative files be lost, damaged of destroyed for the reasons beyond control, Pics305 liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods successfully delivered.
7. ON THE DAY
i. Service start and end time will be as specified at the time of booking.
ii. Parking is an extra fee to be paid by client on the day of the shoot or on our website (Pics305.com) after the shoot is complete. Digital files or any other product purchased will not be delivered until parking fees are paid.
8. PERSONAL ACCIDENT
i. The photographer cannot be held responsible for any injuries during a photographic shoot. Pics305 is not responsible nor liable for any injury that may occur.
9. CANCELLATION FEES
i. Service booking payments will be non-refundable 2 days before service date.
ii. Changes in booking times may result in a rescheduling fee.
10. DELIVERY
i. Pics305 strives to make images available within 48 hours starting at the end of service, but are not liable for damages if delivery takes more than 48 hours.
ii. Delivery during high season or multiple hour events/shoots may take 3-5 days.
